بررسی فقهی، حقوقی حقوق غیرمالی زوجین در حقوق ایران و فرانسه

امروزه یکی از بخش‌های اساسی حقوق مدنی در هر کشوری حقوق خانواده می باشد. و ثبات و دوام خانواده به عنوان کوچکترین و در عین حال مهمترین گروه در هر جامعه ایی همین حقوق می باشد. یکی از بخش‌های مهم این حقوق روابط و حقوقی است که میان زوجین وجود دارد. این پژوهش با هدف بررسی تطبیقی حقوق غیرمالی زوجین در حقوق خانواده ایران و فرانسه انجام گردید. در این تحقیق از روش تحقیق توصیفی تحلیلی استفاده شده است. داده‌ها بر اساس حقوق خانوداه در ایران و حقوق مدنی فرانسه جمع آوری گردید. یافته‌ها نشان داد که در حقوق ایران که بر مبانی فقه اسلامی نشات می گیرد حقوق غیر مالی زوجین در موارد متعددی به نفع زوج و اقتدار مردان می باشد. چنانچه در رابطه با بهره مندی از نام خانوادگی، حق اشتغال زوجه، حق تعیین مسكن مشترك، تابعیت و ریاست، حق طلاق و حق اقتدار پدر در ازدواج فرزند، حق ولایت با پدر یا جد پدری می باشد. اما در حقوق فرانسه در مسیر فرایند تاریخی و تکمیلی خود، حقوق غیر مالی زوجین جنبه اشتراکی داشته و هر دو از حقوق یکسانی برخوردار هستند.
