Criminological legal study of crimes committed by terrorist-takfiri groups with emphasis on ISIS

This research aims to investigate and study "Criminological legal study of crimes committed by terrorist-takfiri groups with emphasis on ISIS". This research is based on the analytical-descriptive method and is also a tool for collecting information from documentary-library sources. Therefore; the results of this research show; in terms of approaches to criminalizing terrorism; ISIS group both has a terrorist essence and uses terrorist methods to achieve its illegitimate goals. In the current situation, despite the actions of some governments in the field of identifying ISIS and including it in terrorist groups (based on the decisions and processes of the domestic laws of the mentioned countries), an international policy in this field that gives the aforementioned description an international and comprehensive nature has not yet been adopted. Therefore, it is necessary for governments, through the Security Council, to include its name in the list of terrorist organizations and impose legal consequences on the performance of this group and its supporters. Iran's criminal policy is an authoritative and strict policy regarding the crimes of the Takfiri terrorist group, but it has some gaps. In general; Although in terms of the court and judicial authorities competent to prosecute ISIS crimes, the Iraqi government is the first country to prosecute and try these individuals, based on the principle of territorial jurisdiction, but more important than prosecution and trial by national courts is the prosecution and trial of ISIS members, especially its leaders, in an international criminal court. Also, unilateral or even bilateral measures do not seem to be sufficient to confront a global threat. International cooperation and coordination are necessary to limit international terrorists.
