Abstract

Legal regulations that specifically operate within Iraq's cyber system have still been halted, and the Iraqi legislator has not kept pace with the world's countries that manage electronic systems. This is because the system has become something that must be implemented, and whether the laws to operate with it have been established or not imposes its own reality, especially the qualitative boom, which is fluctuating every moment. Moreover, if we hear that there is innovation for other devices that the world has not yet seen or is not familiar with. Therefore, in this chapter, we have chosen the title "Legal Legislation Considering the Challenges and Presence of Cyberspace in Iraq," because the challenges that Iraq faces daily are challenges of proving the existence of the state since its disappearance. The introduction of modern devices into the provinces of Iraq, with the increase in users and the prevalence of new thinking in employing individuals for entertainment on one hand, and the work and exploitation of those devices as a source of easy labor is not simple. The work and employment of the workforce, who operate in all practical fields, whether at the governmental, private, or civil public level, and for this reason, this chapter is divided into two parts. In the first section, titled "The Legal System of Iraq and Its Laws in Cyberspace: Capabilities and Challenges," we endeavor to present the most important legal content used in Iraq in combating cybercrimes or actions conducted in the electronic domain. The second section or topic will focus on "Capabilities and Challenges in Cyberspace."
